Terms of Service

These terms are an agreement between you and Pixel Drift Studios ("we", "us"), the maker of FamSync. They cover the FamSync apps for iPhone and Android, the FamSync website and related services (together, "FamSync"). By creating an account or using FamSync you agree to them and to our Privacy Policy. If you do not agree, please do not use FamSync.

1. Accounts and eligibility

You must be at least 13 (or the minimum age to consent to data use in your country) to create your own account. Younger children may use FamSync only as part of a family set up by a parent or guardian, who agrees to these terms for them and is responsible for their use. If you are under 18, a parent or guardian must agree to these terms for you.

Give accurate information, keep your sign-in secure, and tell us if you think someone else is using your account. You are responsible for what happens under your account.

2. Families

A family in FamSync is a shared space. Anyone with your family code can ask to join, so share it only with people you trust. Family admins can invite and remove people, add members who do not have a phone, and change family settings. Everything added to a family space, including events, lists, photos, board posts and shared locations, is visible to its members. When you add information about another person, such as a child, you confirm you have the right to do so.

3. Location, drives and safety

Location sharing, arrival alerts, drive tracking, arrival times and "I'm safe" check-ins depend on phones, signal, battery, settings and third-party map data, and they can be late, inaccurate or unavailable. FamSync is not an emergency or safety service. Do not rely on it to know that someone is safe, and in an emergency call your local emergency number. Share someone's location only with their permission, or as their parent or guardian. Never use FamSync to track a person without their knowledge. Do not use the app while driving.

4. FamSync Premium, trials and billing

  • Plans. Some features need FamSync Premium, sold as a monthly or yearly subscription. The price and what is included are shown in the app before you buy. One subscription covers your whole family, up to 8 people.
  • Payment. Purchases are made and charged through the Apple App Store or Google Play, under their terms, using the payment method on your Apple or Google account.
  • Automatic renewal. Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the current period ends. Your account is charged within 24 hours before renewal.
  • Free trials and offers. If a plan includes a free trial or an introductory or loyalty discount, the terms are shown before you subscribe. At the end of a free trial the paid subscription starts unless you cancel at least 24 hours before the trial ends. Offers are limited to one per person or account, and we may end an offer for future purchases at any time.
  • Cancelling. Cancel at any time in your Apple ID subscriptions (iPhone: Settings, your name, Subscriptions) or in Google Play (Play Store, profile, Payments and subscriptions, Subscriptions). You keep Premium until the end of the period you paid for. Deleting the app does not cancel a subscription.
  • Refunds. Refunds are handled by Apple or Google under their policies; we cannot issue them directly. This does not affect any refund rights you have under the law where you live.
  • Price changes. If a price changes, Apple or Google will tell you in advance and, where required, ask for your agreement before you are charged the new price.

5. Foxy and AI features

Foxy, the in-app assistant, uses AI to answer questions, draft plans and suggest events. AI can be wrong or incomplete. Check anything important, such as times, places, medical, legal or money matters, before you rely on it. Foxy asks before it saves or sends anything on your behalf, and you are responsible for what you approve. Do not use Foxy to create content that breaks the rules below.

6. Google, Instacart and other services

FamSync can connect to services run by other companies, such as Google Calendar, Gmail, Apple Calendar, Instacart and map and weather providers. Your use of those services is governed by their own terms, and we are not responsible for them. When FamSync fills an Instacart cart, it does so in your own Instacart account; checking out, prices, availability and delivery are between you and Instacart. FamSync is not affiliated with or endorsed by Apple, Google, Instacart or the other companies named in the app.

7. Your content

You keep ownership of what you put into FamSync. You give us a limited, worldwide licence to store, copy, process and display it only as needed to run FamSync for you and your family, including through the service providers listed in our Privacy Policy. The licence ends when the content is deleted, except for copies kept briefly in backups or as required by law. If you send us ideas or feedback, we may use them without owing you anything.

FamSync, including its software, design, mascot, name and logo, belongs to Pixel Drift Studios and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own family's non-commercial use under these terms.

8. Rules

Do not:

  • break the law, or harass, threaten, stalk or harm anyone, including by tracking them without their permission;
  • post content that is illegal, sexual content involving minors, hateful, violent, or that infringes someone else's rights;
  • try to access another family's data, break our security, or overload, scrape or reverse engineer FamSync except where the law allows;
  • resell FamSync or use it to build a competing product, or share an account or subscription in ways the App Store or Google Play do not allow.

We may remove content or suspend or close an account that breaks these rules or puts others at risk. Where it is reasonable, we will tell you why and give you a chance to respond.

9. Warranties and liability

We work hard to keep FamSync reliable, but it is provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those in these terms, including that FamSync will be uninterrupted, error-free, or that reminders, alerts or locations will always be delivered on time.

To the extent the law allows, Pixel Drift Studios is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or missed events, and our total liability for any claim relating to FamSync is limited to the greater of the amount you paid for FamSync in the 12 months before the claim, or US$50. Some places do not allow these limits, so they may not apply to you; nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or fraud.

If you use FamSync in breach of these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, to the extent the law allows.

10. General

  • Ending these terms. You can stop using FamSync and delete your account at any time in the app. We may stop offering FamSync or a feature; if we shut FamSync down we will give you reasonable notice and a way to export your data.
  • Changes. We may update these terms. If a change matters, we will tell you in the app before it takes effect. If you keep using FamSync after that, the new terms apply.
  • Disputes. Please contact us first; most problems can be solved quickly. These terms are governed by the laws of the United States and of the U.S. state in which Pixel Drift Studios is based, without regard to conflict-of-law rules, and disputes will be heard in the courts there. If you are a consumer in the EEA, UK or another country that gives you the right, you can also bring a claim in your local courts under your local law.
  • Apple. If you got FamSync from the App Store: these terms are between you and us, not Apple. Apple is not responsible for FamSync or its content, has no obligation to provide maintenance or support, and is not responsible for claims relating to FamSync, including product liability, legal compliance or intellectual property claims. If FamSync fails to meet a warranty, you may notify Apple for a refund of the purchase price, if any, and Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you are not in a country subject to a U.S. embargo and are not on a U.S. government list of prohibited or restricted parties. Apple's standard licensed application end user licence agreement applies to the extent these terms do not cover something.
  • Everything else. If part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver. You may not transfer these terms; we may transfer them as part of a sale or reorganisation of FamSync. These terms and the Privacy Policy are the whole agreement between us about FamSync.
